Terms & Conditions

These Terms of Service ("Terms") govern your access to and use of emilysnaturals.com and any related sites, content, and services (collectively, the "Site"). The Site is operated by Sendayco, LLC, doing business as Emily's Naturals ("Emily's Naturals," "we," "us," or "our").

By accessing the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to use this Site. Minors may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms.

2. About Our Site and Products

Emily's Naturals provides information about handcrafted, natural personal care and household products, including Neem Oil and Castile Soap. We do not sell products directly through this Site. Where you see a product featured, we may direct you to a third-party retailer, including Amazon.com, to complete any purchase. Any transaction you complete on a third-party site is between you and that retailer, not us — see Section 6 below.

We work to display product descriptions, ingredients, and images as accurately as possible, but we do not warrant that this content is complete, accurate, or error-free, and actual products may differ from what's shown or described here. Please refer to the product listing and packaging on the retailer's site for the most current information before purchasing.

Important health note. Our products are personal care and household items. Statements about our products have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. Always read labels and ingredient lists, and perform a patch test before first use of any personal care product. If you have a medical condition, allergy, or sensitivity, or are pregnant or nursing, consult a qualified healthcare provider before use. Discontinue use if irritation occurs. Products intended for use on plants are for that purpose only — keep out of reach of children and follow the instructions provided with the product.

3. Customer Reviews and Submissions

If you submit reviews, photos, comments, or other content to the Site or to our social media channels ("Submissions"), you represent that the content is your own, is accurate, and does not infringe anyone's rights or violate any law. Submissions are non-confidential. You retain ownership of your Submissions, but you grant us a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, sublicensable license to use, reproduce, modify, publish, and display them in connection with our business and marketing. We may, but are not obligated to, monitor, edit, or remove any Submission at our discretion.

4. Acceptable Use

You agree not to use the Site to do anything unlawful, fraudulent, harassing, defamatory, infringing, or otherwise harmful. You agree not to interfere with or disrupt the Site, attempt to gain unauthorized access to any part of the Site or its systems, probe or test its security, introduce malware, scrape or harvest data, or use the Site or its content for commercial purposes without our written permission.

5. Intellectual Property

The Site and its content — including text, images, photographs, graphics, logos, designs, and software — are owned by or licensed to Emily's Naturals and are protected by intellectual property laws. The Emily's Naturals name, logos, and trademarks may not be used without our prior written consent. You may view, download, and print Site content for your own personal, non-commercial use only. 6. Third-Party Retailers and Links

The Site contains links to third-party websites, including Amazon.com, where you can purchase products we feature. We provide these links for your convenience only. Once you leave our Site to visit a third-party retailer:

  • Your purchase, payment, order fulfillment, shipping, and any return or refund are governed entirely by that retailer's own terms of service, privacy policy, and return policy — not by these Terms.
  • We do not control, endorse, or take responsibility for the third-party site's content, pricing, availability, security practices, or business practices.
  • We are not a party to any transaction you complete on a third-party site, and we have no ability to process, modify, or refund purchases made there.

For issues with an order, please contact the retailer (e.g., Amazon Customer Service) directly. Accessing third-party sites is at your own risk and subject to their terms.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that it will be free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMILY'S NATURALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING ANY PURCHASE YOU MAKE THROUGH A THIRD-PARTY RETAILER LINKED FROM THE SITE. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Emily's Naturals and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

Your use of the Site and any information you provide are subject to our Privacy Policy, which is incorporated into these Terms.

11. Governing Law

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any action that proceeds in court will be brought exclusively in the state or federal courts located in Montgomery County, Ohio (Dayton), and you consent to the personal jurisdiction and venue of those courts.

12. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. General

These Terms, together with the policies incorporated by reference, are the entire agreement between you and Emily's Naturals regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. No agency, partnership, or employment relationship is created by these Terms.
